Amendments to Law no. 238 of 2016
“Organic discipline of the cultivation of vines and the production and trade of wine” (so-called “Consolidated Law”)
We inform you that it was published in the GURI n. 228 of 09/14/2020, Law 11 September 2020 n. 120 conversion into law, with amendments, of Legislative Decree 09/16/2020 n. 76, containing urgent measures for simplification and digital innovation.
The text of the Law provides, among many things, to the art. 43-ter also some amendments to Law no. 238 of 2016 in this regard:
– Advance start of the harvesting campaign to July 15th (previously the start was set for August 1st)
(amendment to art. 10 - Determination of the harvest period and fermentations paragraph 1)
– Possibility of using the mentions “superiore” in combination with the mention “riserva” (previously it was forbidden to combine it with both the mentions “novello” and the mention “riserva”)
(amendment art. 31 - Specifications, mentions, vines and production year paragraph 5)
– New more restrictive rules for the transition from DOC to DOCG, increasing the minimum representation percentages (from 51% to 66%) of the claiming winemakers and of the vineyard area claimed for the purpose of the transition
(amendment art. 33 - Basic requirements for the recognition of DOs and GIs paragraph 1)
– The attribution of the qualification of public security agent for supervisory agents appointed by the Consortia becomes optional and no longer mandatory
(amendment to art. 41 - Protection Consortia paragraph 5)
– Simplification of the closure system, with the abolition of the obligation to display the name or company name, or the registered trademark or the ICQRF code of the bottler on the capsule
(repeal of art. 46 - Container locking system)
– Obligation also for control bodies of a public nature to obtain accreditation according to the UNI CEI EN ISO/IEC 17065:2012 standard
