Second notice

PUBLIC AUCTION FOR THE SALE OF 1 CAR

USED OWNED BY IRVOS.

 

In execution of Regional Law n. 09/2013 art. 22, relating to the ban on public administrations from owning and using cars exceeding 1300 cc in engine capacity, IRVOS will, through a public auction, sell the vehicle listed below:

– SUBJECT OF THE AUCTION

The car will be put up for sale in its current state. The IRVOS

is not responsible for any hidden defects in the goods sold. The successful tenderer will therefore not be able to

raise exceptions in this regard.

The car up for auction is the following:

– VISION OF VEHICLES

Those interested in purchasing the goods described above can view the vehicles with the

relevant documentation in the possession of the Institution, by appointment. To this end they can contact

at the Consignee's Office, at the headquarters in Via Libertà, n. 66– Palermo tel. 091-

6278250 or 091 6278244, from Monday to Friday, from 8.30am to 12.30pm. Taking requests

Views of the vehicles must arrive by 12.00 on 18/07/2014.

 

– SUBJECTIVE REQUIREMENTS TO PARTICIPATE IN THE AUCTION

To participate in the auction procedure, bidders must possess the following requirements, which must be attested

with declaration to be made pursuant to Presidential Decree 445/2000:

– not be disqualified, disabled or bankrupt or subjected to other insolvency or non-insolvency proceedings

have ongoing procedures for the declaration of any of these states:

– there are no convictions or other measures against you that would lead to loss

o the suspension of the ability to contract with the Public Administration;

– not be insolvent towards the Province of Parma for sums of money owed

for taxes, fees, rents, indemnities, fees or any other title.

 

– AWARD CRITERION

The auction will be held using the secret offer method and the award will take place using the criterion

of the highest bid compared to the tender amount.

 

– PARTICIPATION METHODS AND SUBMISSION TERMS

OF OFFERS.

To participate in the tender, the competitor must send IRVOS a package for which he intends to submit an offer, containing the documentation referred to below.

Conditional offers are not permitted.

The application for participation in the auction and the offer must be drawn up exclusively in the language

Italian.

Persons interested in participating in the auction must send exclusively to the following

address:

Via della Libertà, 66 – 90143 Palermo

no later than 12.00 on the day 17.12.2014 (peremptory term) an envelope duly closed and sealed and countersigned on all closing flaps. The package must bear the words "Auction

public for the sale of n. 1 car owned by IRVOS"

as well as the name and address of the sender.

The package must be delivered directly by hand to the aforementioned address or delivered to

by registered mail. Any other means of delivery will not be considered valid, therefore i

competitors who have not respected this provision will not be admitted to the auction.

The timely and regular delivery of the package is at the sender's sole risk. The deadline has passed

fixed for the reception of applications, no offer will be recognized as valid, even if it replaces it

or additional to a previous offer and even if the delay is due to force majeure. Not

Applications for participation or offers containing abrasions or corrections are permitted.

DOCUMENTATION

Under penalty of exclusion, the package must contain two envelopes, each of which is sealed

and countersigned on the closing flaps and the words, respectively, “A – APPLICATION FOR

PARTICIPATION” and “B – ECONOMIC OFFER”.

On the outside of both envelopes, it must be indicated the sender, and the following wording “Public auction for the sale of n. 1 car owned by IRVOS”.

-Envelope “A – APPLICATION FOR PARTICIPATION”

The "APPLICATION FOR PARTICIPATION" envelope must contain, under penalty of exclusion, the

following documentation:

a) application to participate in the auction, drawn up in Italian, duly signed. At the

The application must be accompanied by a photocopy, front-back, of an identity document (in progress

validity) of the subscriber.

In the case of an attorney, the original or certified copy of the notarial power of attorney must also be attached

notarial.

In the case of a company, the application must be completed and signed by the legal representative of the company

itself or by another person with suitable powers of representation.

The application for participation must contain: under penalty of exclusion, the declarations listed

in Annex A) to this Notice, to be made pursuant to art. 46 and 47 of Presidential Decree 445/2000.

-Envelope “B – ECONOMIC OFFER” must contain, under penalty of exclusion, the following

documentation:

a) Financial offer, drawn up on stamp duty and in Italian, expressed in figures and letters, relating to the

single Lot, duly signed in full. The financial offer must be attached in the

same envelope, photostatic copy, front-back, of an identity document (valid)

of the subscriber. The offer must contain, under penalty of exclusion, the declarations listed

in Annex B) to this Notice.

In case of discrepancy between the amounts indicated in figures and those in words, for the purposes of the award,

those most advantageous for IRVOS will prevail.

Economic offers must be equal to or greater than the base price

of auction. Bids of an amount lower than the starting auction price will not be taken into consideration.

Bids made by a person to be nominated will not be accepted.

The award may be made even if only one valid offer is submitted.

 

 

 

– METHOD OF CONDUCTING THE AUCTION

The auction will be chaired by a special duly constituted Commission and will take place with

secret bidding system.

The tender commission at 10.00 am on 18/12/2014, at the IRVOS headquarters in Via

della Libertà, 66 – Palermo, will proceed with the opening of the packages received,

following verification of the applications for participation, the provisional award will be made,

in favor of the bidder who has submitted the highest offer.

In case of discrepancy between the offer price in figures and that indicated in words it will be considered

the most advantageous one for the Administration is valid.

The auction will be a single and definitive auction and the award will be made even in the case of a single auction.

In case of equal offers, the art. will apply. 77 paragraph 2 of RD n. 827/1924, that is, yes

will proceed by drawing lots.

Competitors who have submitted an offer, equipped with an identification document, can

participate in the competition session as listeners.

IRVOS reserves the right to change the date of the auction session; then

timely communication will be given by publishing a notice on the website (www.irvos.it).

 

– FINAL AWARD

The final award will be made through determination, once the appropriate procedures have been completed

checks.

Once the award has been made, the documents for the vehicle(s) will be delivered to the winning bidder

the operations relating to the transfer of ownership, which must be carried out at the care and expense

of the successful tenderer himself and to be agreed upon in terms and methods with the Consignee's Office.

 

– PAYMENT OF THE PRICE

The successful tenderer must pay the sum no later than 5 (five) days from the date of

award, otherwise he will be considered to have lost all rights.

The signing of the sales contract is subject to payment of the price to the IRVOS-Accounting Office to be made by paying the same to the Institution's Treasury.

As regards the unit awarded, the collection of the vehicle must take place after the payment of the

balance and upon presentation of the documents certifying the new ownership which must in any case be

copied to the Institution no later than 5 days after notification of the notification

award.

 

– STIPULATING THE DEED OF PURCHASE

The successful tenderer must prove that he has paid the price offered by bank transfer

bank and/or by bank draft, upon signing the transfer of ownership.

The cars will be delivered after the aforementioned passage has been completed.

All costs for stipulating registration and transcription of the deed of sale and any other deed

arising and consequent, will be borne by the buyer.

 

– OTHER PROVISIONS RELATING TO THE PROCEDURE.

The Regional Institute of Wine and Oil of Palermo reserves the right, at its sole discretion and at any stage of the procedure, not to hold the auction, to revoke it, to extend it, to suspend it and/or to postpone it to another date, without the participants being able to make any claims in this regard.

 

 

 

– DISPUTES

For any dispute that may arise, the Court of Palermo is competent

– PROCEDURE AND INFORMATION MANAGER

Pursuant to art. 5 of Law 241/1990 we inform you that the person responsible for the procedure is Mr. Rosario Geraci, consignee of the organisation.

– DATA PROCESSING

Pursuant to art. 13 of Legislative Decree 196/2003 we inform you that:

– the processing of personal data provided by auction participants has the purpose of ensuring

the carrying out of the same and the consequent obligations;

– any refusal to make the required declarations will result in exclusion from the

auction procedure:

– the data relating to the subjects participating in the auction may be communicated to the competent offices

public, to subjects external to the IRVOS of Palermo involved in the procedure, to

participating competitors, to other subjects entitled pursuant to Law 241/1990;

– the owner of the processing of personal data is Irvos of Palermo.
